Phonexa’s Consent Branches: TCPA and FCC Compliant One-to-One Consent Solution

With the FCC's new regulations which will take effect in January 2025, businesses have to obtain explicit consent from consumers before contacting them via automated telephone dialing system (ATDS). Phonexa's Consent Branches (also known as legs) allow affiliates, affiliate networks, and service providers to obtain individual consent from consumers to comply with the new FCC and TCPA requirements. The consent branch system is integrated into Phonexa's Smart Tree technology, providing full transparency for the publisher, network and the consumer. You can enable consent branches with your own forms using our existing APIs or you can leverage Phonexa's proprietary Form Builder, to ensure that the consumer is provided all relevant, available options for service providers.

The consumer is matched with multiple service providers and presented with unique consent language tailored for each service provider on a single form, requiring them to provide consent individually.

Consent language is tailored to each specific provider for this scenario. As a result, the consumer would have provided clear authorization to receive marketing messages from each specific brand with unique disclosures.

Generic Consent Language for Multiple Brands:

Scenario:
The consumer is presented with one disclaimer that includes generic language for multiple brands or service providers. The consumer would agree to be contacted by a range of selected brands via ATDS agreeing to the general disclaimer.
Benefit:
This consolidates multiple brand consents into one broad disclaimer, which is effective when multiple brands or service providers are presented to the consumer. Generic consent language may not provide the same level of granularity as unique consent disclaimers provided for each brand.

Scenario:
When Phonexa users, acting as a network, use Phonexa to receive pings (non-PII) from publishers' data to match with suitable service providers, Phonexa then replies to the publisher with multiple consent branches, each tailored to the specific service provider (this may include Company Name, custom consent, link to logo, bid, etc.)

Those providers are then presented to the consumer on the publishers' form, where the consumer provides the consent for the service providers to contact them via ATDS / SMS. After the consumer selects the service provider(s), and provides their consent, the data will be posted through Phonexa to the service providers the consumer selected.
Benefit:
This approach ensures that publishers and advertisers can collaborate with multiple partners simultaneously. Each service provider receives explicit and specific consent from the consumer, tailored to their particular requirements using Phonexa to manage the data and consent capture effectively.
